After deliberations, Superior Court Judge Garry S. Rothstadt ruled, and a trial date is set in the lawsuit claiming an aluminum bat made by Louisville’ Hillrich & Bradsby may have been the cause of injury in the case of a 12 year old Steven Domalewski.
Domalewski suffered brain damage during a 2006 Little League Game, when he was hit by a ball in the chest, by the line drive off the aluminum bat of his opposite team mate.
The Record reported “the lawsuit filed by the family of claims Kentucky-based bat maker Hillerich & Bradsby Co., national retailer The Sports Authority, Inc.; Little League, Inc.; and New Jersey Little League are responsible for their son's injuries.”
Hillerich & Bradsby have denied the claims. Little League Inc. also denied the claims, saying,” The aluminum bats are more dangerous than wooden ones.” They say there is no evidence to the contrary.
The trial is scheduled to begin on September 10, 2012 in state Superior Court in Paterson, New Jersey.
