A look at safety misconduct defenses to worker's comp claims in Kentucky, Indiana and Tennessee. Most safety professionals are aware that workers compensation is a no-fault remedy for workers injured on the job. Known to a lesser extent is the fact that many states' workers' compensation statutes provide defenses to compensability or means to reduce the amount of benefits an injured worker is eligible to receive when they violate a safety rule, fail to use safety equipment, or have a positive post-accident drug and / or alcohol test. Collectively these issues are referred to by the presenter as "safety misconduct". This presentation will explore the relatively narrow parameters of application and burdens that employers must satisfy if they plan to successfully raise a safety misconduct defense. A comparison of the law from the three states most central to the Louisville chapter will serve as the backdrop for the presentation.
